Overview

These terms and conditions form a contract between User (hereinafter “you” or “your”), both Business users/Taskers and Customers and PASSION VENTURES PTY LTD (ABN: 15 628 340 723) d/b/a “TASKEASY” that governs user’s access and use of the website and our services (collectively as the “Services”). Please read these Terms carefully. It is a legally binding agreement between you and TASKEASY. By your use of the website, you agree to comply with all of the terms and conditions set out in this document. We may terminate your Account or block your Internet Protocol (IP) address at any time, with or without notice, for conduct that is in breach of these Terms, for conduct that we believes is harmful to our business, or for conduct where the use of the website is harmful to any other party. 

The domain name Taskeasy.com.au hereinafter referred to as "Website") is owned by PASSION VENTURES PTY LTD, a company incorporated under the laws of Australia at Melbourne (hereinafter referred to as “we”, “us”, “our”, “TASKEASY”, or “Company”). 

Your use of the Website, services and features are governed by the following terms and conditions ("Terms"). If you transact on the Website, You shall be subject to the terms and policies that are applicable to the Website and services for such transaction. 

YOU ACCEPT THESE TERMS BY CLICKING THE "SIGN UP" BUTTON WHEN REGISTERING A TASKEASY ACCOUNT AND BY OTHERWISE ACCESSING OR USING THE TASKEASY WEBSITE, SERVICES, APPLICATIONS AND TOOLS, INCLUDING POSTING A JOB/TASK AND SENDING QUOTES TO CUSTOMERS. 

1. SCOPE OF SERVICES 
TASKEASY is an online marketplace that enables customers to post jobs/Tasks. After posting a task, Taskers may quote in response to a posted task. Our website contains features that enable Taskers and customers to do, among other things, the following:

1. Customers: Create profiles, post jobs/tasks, search for Businesses/Taskers, communicate with Taskers, negotiate with Taskers, award jobs/tasks to Taskers, manage and amend jobs/tasks, leave reviews for Taskers after completion of project. 
2. Businesses/Taskers: Create profiles, advertise capabilities, submit quotes, negotiate with customers, obtain project awards, invoice, receive reviews.

 

2. REGISTRATION
To access our Services through our Website, you must be a legal entity, or an individual of eighteen (18) years of age or older who can form legally binding contracts. To become a Registered User, you must accept all of the terms and conditions in, incorporated by reference in, and linked to, these Terms. By becoming a Registered User, you agree to: (1) abide by the Terms of Service and the processes, procedures, and community guidelines described throughout the Website; (2) be financially responsible for your use of the Website and the purchase or delivery of services; and (3) perform your obligations as specified by any Project Agreement that you accept, unless such obligations are prohibited by law or by the Terms and Conditions. TASKEASY reserves the right, in its sole discretion, to refuse, suspend, or terminate Services to anyone. TASKEASY may, in its sole discretion, refuse to allow any person to register or create an account with TASKEASY or cancel or suspend any existing account.

Username and Password: After Sign-up, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer system, and you agree to accept responsibility for all activities that occur under your account or password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with these Terms, We shall have the right to indefinitely suspend or terminate or block access of your IP on the Website or suspend your account and refuse to provide You with access to the Website. User agrees to notify TASKEASY immediately of any unauthorized use of User’s Account. TASKEASY shall not be liable for any unauthorised use of User Account.

 

3. CUSTOMER/USER OBLIGATIONS
3.1 All Registered Users represent, warrant, and agree to:

1. comply with these terms, including our Privacy and Cookies Policy, and all applicable laws and regulations; and
2. Publish accurate and correct information on our platform.

3.2 Users are solely responsible for all materials that they upload, post, transmit, or otherwise make available on the Website (“Users’ Content”). 

3.3 Each User represents and warrants that he/she owns all intellectual property rights in the User’s Content and that no part of the User’s Content infringes any third party rights. 

3.4 Users further confirm and undertake to not display or use of the names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights of any third party on the Website.

3.5 User agrees that any content on our platform may not be used on third party sites or for other business purposes without our prior permission.

3.6 User agrees not to use our platform for any illegal purpose.

3.7 Users agree to indemnify and hold harmless the TASKEASY, its directors, employees, affiliates and assigns against all costs, damages, loss and harm including towards litigation costs and counsel fees, in respect of any third party claims that may be initiated including for infringement of intellectual property rights arising out of such display or use of the names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights on the Website, by such User or through the User’s commissions or omissions. 

3.8 User acknowledges and agrees for not to use, nor permit any third party to use, the website to distribute, link to, publish, reproduce, engage in or transmit any of the following, including but not limited to: 

• Illegal and fraudulent information;
• False, inaccurate or misleading or deceptive information;
• Illegal and fraudulent activities; 
• threatening, harassing, inappropriate or objectionable information/content communications of any kind, including without limitation conduct that would encourage "flaming" others, or criminal or civil liability under any local, state, federal or foreign law;
• Any other information or Content which is not legally yours and without permission from the intellectual property rights owners;
• Any malicious code, data or set of instructions that intentionally or unintentionally causes harm to the intended function of our platform, including, but not limited to viruses, Trojan horses, worms, time bombs, cancel bots, Easter eggs or other computer programming routines that may damage, modify, delete, detrimentally interfere with, surreptitiously intercept, access without authority or expropriate any system, data or Personal Information.

3.9 User must have the right to provide Services under a Task Contract and to work in Australia. User must comply with tax and regulatory obligations in relation to any payment received under a Task Contract.

3.10 User acknowledges that his/her posted task may be deleted from the website, in case TASKEASY believe these Terms are breached, either directly or indirectly. We reserve the right to suspend or delete User account in the following cases (“Prohibited Activities”) [Please note that the below list is not exhaustive]:

• If you breach, in our opinion, these Terms and Conditions, which include, without limitation, the Privacy Policy and Cookies Policy;
• If after posting task you accept the fees outside this platform;
• If you post you task, after receiving warning notice, in the wrong category;
• If you post duplicate task to defraud other users; and
• If we believe that your behaviour is suspicious or you are engaged in suspicious activities.

4. VERIFICATION 
For the purpose of verification of the information provided, we may require you to perform certain actions for verification of your identity including e-mail address, mobile phone number, as well as for verification of the accuracy of the information and the documents provided by you. You agree that our Identity Verification Services may not be fully accurate as all Services are dependent on User’s information and verification services provided by third parties. 

We conduct thorough background checks on our business members or Taskers through reputable third-party identity verification services such as the Document Verification Service (DVS) and Australian Business Register (ABR). While these checks provide valuable insights, it's important to note that they may not be foolproof and could potentially be bypassed with falsified documentation. As a result, we are unable to guarantee the absolute accuracy of every business user's claimed identity. We strongly advise you to conduct your own background checks on any businesses before engaging them for your tasks.

5. POSTING A JOB/TASK
Posting your job on the Taskeasy platform to receive quotes from businesses comes at no cost to you. However, upon accepting a quote and entering a contract with a business for the job, you assume sole responsibility for the work performed by that business. Taskeasy bears no liability for the invoices or expenses incurred by businesses that successfully bid for your job.

Before accepting a quote, we encourage customers to conduct their own due diligence and assessments to ensure the credibility and suitability of the business for the task. 

JOB/TASK POSTING GUIDELINES: When posting on TASKEASY please make sure that your Job/Task has clear and complete titles and descriptions. Each Task should be posted only once, no duplicate tasks are allowed. Additionally, we do not allow the following type of postings:

1. Illegal Task Posting;
2. Posting of Prohibited items;
3. Posting of escort or adult services; and
4. Posting of Business Advertisements.

 

Illegal Task Posting: Illegal Task means any task which includes but not limited to, solicitation, encouragement of illegal acts, scams and fraud acts. To ensure a safe and secure experience for all our users, at TASKEASY, all Illegal acts our prohibited.

Posting of Prohibited items: Users may not sell or promote any of the items listed below (including but not limited to) :

1. Any illegal or unlawful goods or services or that encourage, promote, facilitate, or instruct others to engage in illegal activity;
2. Foreign Currency Exchange services;
3. Live animals, Human body parts/fluids/remains;
4. Items that include computer viruses, worms, Trojan horses, dishonest adware, crime-ware, unauthorized root-kits, and other malicious and/or illegal software;
5. Pharmaceuticals, prescription/unapproved drugs and devices mimicking illegal drugs;
6. Phone unlock services, Jail breakers; and
7. Weapons, Firearms, ammunition, explosives and hazardous materials.

 

Posting of escort or adult services: Users may not sell or promote any of the items listed below (including but not limited to) :

1. Escort & Bride catalogues, sexual services, mail order brides, prostitution; and
2. Pornography and adult content featuring children and/or any individuals; and/or featuring rape/violence/bestiality and/or all other illegal sexual content. 

 

Posting of Business Advertisements: TASKEASY is not a platform for business advertisements, nor a job board for permanent job ads. TASKEASY is also not a platform for any requests to be employed.

SHARING OF PRIVATE INFORMATION: After acceptance of offer, users may share private contact details required for completion of posted task; But before acceptance of offer, we do not allow sharing of private contact details (Personal emails, phone numbers, addresses or Personal websites). Further, we do not allow sharing of 3rd party links including Facebook, LinkedIn and Twitter. 

UNACCEPTABLE BEHAVIOURS: Unacceptable behaviour (including bullying, harassment and victimisation), may involve actions, words or physical gestures that could reasonably be perceived to be the cause of another person’s distress or discomfort.  Bullying or harassment may be by an individual against an individual or involve groups of people. At TASKEASY, we do not accept such behaviours. TASKEASY expects that all users will conduct themselves in a professional manner when interacting with others.

Harassment: Harassment is connected to anti-discrimination legislation. Therefore if any user is on the receiving end of unacceptable behaviour which relates to their sex, race, sexual orientation, age, disability, religion or belief or gender reassignment (collectively known as ‘the protected characteristics’), this will be deemed to be harassment. At TASKEASY, Actions or comments that may cause distress or jeopardise other users of the community are not allowed. This may include persistent disturbance, torment, intimidation or communication aimed at influencing other user's offers, all of which are strictly not allowed. 

Bullying: Bullying is a broader concept which may generally be characterised as offensive, intimidating, malicious or insulting behaviour, an abuse or misuse of power through means that undermine, humiliate, denigrate or injure the recipient.

Trolling: A troll is a person who starts quarrels or upsets people on the Internet to distract and sow discord by posting inflammatory and digressive, extraneous, or off-topic messages in an online community. At TASKEASY, Tasks and comments that are deemed to be trolling or inappropriate are prohibited. 

 

Victimisation: Victimisation is unfavourable treatment of a person (‘the victim’) to a detriment because they have (i) brought discrimination (including harassment) proceedings or given evidence or information in connection with such proceedings; (ii) done anything other thing in connection with discrimination (including harassment) proceedings; (iii) made an allegation (whether expressly or otherwise) of discrimination or harassment; (iv) or because it is suspected that the victim has done or intends to do any of these things. At TASKEASY, victimisation is prohibited.

UNSUPPORTED PRACTICES: At TASKEASY, we do not support the following activities within our community, as it jeopardises the creation of a fair, transparent and trustworthy environment, which we highly value.

1. Fraudulent reviews;
2. Artificially improving public profile;
3. Discussion forum;
4. Harvesting member information; and
5. Lead generation.

Fraudulent reviews: Trust is crucial for every online platform like us, therefore creating or requesting fraudulent reviews for any task is prohibited on TASKEASY platform. All users are responsible to maintain integrity, authenticity, honesty and transparency of their profile and task.

Artificially improving public profile: Artificially improving your public profile, including the manipulation of Completion Rates, is prohibited on TASKEASY platform as it jeopardises the creation of a fair and trustworthy system.

Discussion forum: TASKEASY is a marketplace for outsourcing short-term tasks and not a forum for discussions. Posters should only comment to give more task information or ask for information about a TASKEASY Worker and their offer.

Harvesting member information: Harvesting member contact details is the process of obtaining lists of contact details. This is not supported by TASKEASY and you should not make an offer/post a task of any such kind. 

Lead generation: Lead generation is the initiation of consumer interest or inquiry into products or services of a particular business. This includes posts about campaigns that involve cold calling, email blasts, contacting key decision-makers, prequalifying them and introducing services where appropriate. This is not supported by TASKEASY and you should not make an offer on any such tasks. 

6. HOW TASKEASY USES YOUR PERSONAL INFORMATION
Taskeasy may use your personal information for the primary purpose for which it was collected, as well as for related secondary purposes. Specifically, Taskeasy typically uses personal information to:

• Personalize and customize your experience on the platform.
• Assist Taskeasy in managing and improving its services.
• Communicate with you via email, SMS messages, or telephone.
• Provide you with ongoing information about opportunities on the platform that Taskeasy believes you may be interested in, through email, SMS messages, or telephone.
  

7. CONNECTIONS TO BUSINESSES & CUSTOMERS
Taskeasy facilitates connections with third-party businesses through links and introductions on the platform. These businesses are independently owned and operated, and Taskeasy does not exert control over them. 

Regarding these introduced businesses:

• Taskeasy provides these links and introductions as a convenience, and their presence does not imply endorsement by Taskeasy of the business.
• Taskeasy is not liable for the actions or services provided by these businesses.

You are solely responsible for selecting a quote and engaging in transactions with the business, including payment for services rendered. Taskeasy does not make recommendations or dictate the choice of a successful business to you.

8. BUSINESSES/TASKER INFORMATION
Taskeasy website is here to share information about your product or service, and your use of the site means you agree to the terms and conditions below.

1. Uploading Information
   • You confirm that you have the authority to share the material, information, and service details.
   • The shared material or information should not harm the reputation of any product, service, person, or company.
   • It should not falsely represent any product or service, causing unfair competition.
   • Your shared material or information should not violate any intellectual property rights, including trademarks, copyrights, or confidential information.
   • It should comply with laws and regulations, including those of Australia and Victoria. 

1. Intellectual Property License Grant

When you upload any intellectual property, such as copyrighted works, trademarks, and service marks, onto the site, you are giving Taskeasy a continuous, non-exclusive, and cost-free license globally. 

• This license allows Taskeasy to reproduce, use, and leverage the intellectual property on the site to the maximum extent permitted by intellectual property law in any jurisdiction where the site is accessible to users.
• Additionally, you authorize Taskeasy to grant the same rights to others, as mentioned in the first point above.
  

2. Quoting

By participating in quoting and winning customers' jobs on Taskeasy, you acknowledge and agree that:

1. All terms and conditions related to the job and the quote form a contract solely between you and the customer, with no involvement or implication of Taskeasy.
2. The customer's selection of the lowest-priced or best quote is not automatically guaranteed, as it is at the customer's discretion.
3. Taskeasy plays no active or inactive role in the customer's method of selecting a quote.
4. Taskeasy assumes no responsibility for the accuracy, reliability, or timeliness of the content provided by a customer posting a job.
5. Taskeasy does not guarantee the authenticity of a provided customer phone number.

By continuing to provide information, you agree to abide by these terms and conditions.

9. SERVICE FEES 
TASKEASY operates on a pay-per-job/pay-per-quote pricing model, specifically charging when a Tasker wishes quote or to view a customer's contact details. These charges apply at the time of accessing this information. 

Taskeasy reserves the right to charge fees for the provision of our services, as outlined on our platform or communicated directly to you. By utilizing our services, you acknowledge your understanding of the features described on our platform or communicated to you directly.

Fees for our services are payable in advance. Upon receiving payment, it is subject to our stated Refund Policy.

For services provided on a recurring subscription basis, you can terminate your subscription by providing us with a written notice at least 21 days prior to your next subscription renewal date.

In the event of non-payment by the specified due date, Taskeasy reserves the right to take necessary actions, including potentially suspending, canceling, or limiting website access. Additionally, Taskeasy may engage debt collection agents or initiate legal proceedings to recover outstanding amounts, and clients are responsible for reimbursing any reasonable incurred costs. 

Additionally, Taskeasy offers optional SMS job alerts for an annual fee. This service provides valuable notifications to enhance your experience. 

Quoting Credit Policy

If you have purchased quoting credits from us, please note the following:

• These quoting credits are exclusively for use within the Taskeasy platform and cannot be redeemed elsewhere.
• Taskeasy credits purchased by users do not expire. Once acquired, these credits remain valid indefinitely for use within the Taskeasy platform. 
  

10. REFUND POLICY
You acknowledge and agree that any fees incurred are non-refundable. 

If you encounter any issues with Taskeasy service and provide detailed reasons for your dissatisfaction, Taskeasy will carefully consider your refund request. Taskeasy may, at its absolute discretion:

• Decline the request,
• Provide credit to your account, or
• Issue a refund for your payment.

Refunds in other circumstances are granted solely at Taskeasy's discretion. Please note that Taskeasy reserves the right to refuse cash or credit refunds if your account is found to be in poor standing or if any abuse is reported against your account.

11. BADGES

TASKEASY is all about helping Taskers and their skills. Taskers can gain Badges based on their activity, performance, reputation and completion of certain conditions. Taskers, who cannot maintain their high quality service, may risk losing their badges and the benefits that come with it. Some badges are subject to a fee charged by TASKEASY at its sole discretion. TASKEASY retains the discretion and right to not issue, or remove without notice, a Badge if Users are in breach of any of the terms of this Agreement, the Badge has been issued incorrectly, obtained falsely, has expired, is no longer valid or for any other reason requiring its removal by TASKEASY.  

12. REVIEWS & FEEDBACK

If User elects to provide any review, suggestions, comments, improvements, information, ideas or other feedback or related materials to TASKEASY (collectively, “Feedback”), User hereby grants TASKEASY a worldwide, perpetual, non-revocable, sub-licensable, royalty-free right and license to use, copy, disclose, license, distribute, and exploit any Feedback in any format and in any manner without any obligation, payment, or restriction based on intellectual property rights or otherwise.

13. TERMINATION OF ACCESS WITH TASKEASY

Taskeasy reserves the right to terminate access to the platform at any time, without providing any explanation or justification for the termination of access.

Termination of User's Account with Taskeasy. 

Taskeasy may, at its discretion, terminate your use of or access to the website at any time. In the event of termination, Taskeasy may notify you by email. Upon termination:

• You are no longer authorized to access the website or utilize any other Taskeasy services using the email address registered with the site or any other email address you possess.
• You will remain subject to and bound by all restrictions outlined in the Terms and Conditions.
• All licenses granted by you and all disclaimers, as well as limitations of Taskeasy's liability, set out in the Terms and Conditions or elsewhere on the website, will continue to be in effect.

 

14. NO AGENCY RELATIONSHIP & TERMINATION 

You agree that no agency relationship exists between User and TASKEASY as a result of these terms. We may terminate your registration and/or deny you access to the Website or any part of it at any time in our absolute discretion and without any explanation or notification. If you want to terminate the Services at any time, you may do so by (a) notifying us and (b) closing your registered account for the Services that you use. 15. LINKS TO OTHER THIRD PARTY WEBSITES 

Certain links on the Website will let you leave the Web site. These linked sites may be operated by the Company while some are not under the control of the Company, and Company is not responsible for the contents of any linked site or any link contained in a linked site. These links are provided for your convenience, and the inclusion of any link does not imply a recommendation or endorsement by Company of any such linked site or the products therein. If you decide to access any third party sites, you do so entirely at your own risk and subject to the terms and conditions of use for such third party sites.

We are committed to protecting your personal information and ensuring its privacy, accuracy and security. Please read our Privacy Policy for more details.

17. ELECTRONIC COMMUNICATIONS

When you visit our website or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We may communicate with you by email. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that the communications be in writing.

18. WAIVER AND SEVERABILITY 

If any provision of these terms is held to be illegal, invalid or unenforceable, this will not affect any other provisions and the Agreement will be deemed amended to the extent necessary to make it legal, valid, and enforceable. The failure of either party at any time to require performance by the other party of any provision of this Agreement shall in no way affect that party’s right to enforce such provisions, nor shall the waiver by either party of any breach of any provision of this Agreement be taken or held to be a waiver of any further breach of the same provision.

19. DISPUTE; JURISDICTION AND APPLICABLE LAW 

Taskeasy is committed to resolving disputes arising from the use of our platform in a fair and timely manner. We will make reasonable efforts to mediate any disputes between parties regarding the website's usage.

Disputes related to the services provided by a business or any other issue will be referred to external dispute resolution services or relevant authorities when necessary. Any disputes arising from these terms and conditions will be submitted to arbitration in accordance with the Rules for the Conduct of Commercial Arbitrations of the Institute of Arbitrators and Mediators, Australia.

Should any part of this Agreement be deemed void, unlawful, or unenforceable, it will be considered separate from the rest of the Agreement, and the validity and enforceability of the remaining provisions will remain unaffected.

This Agreement will be governed by and interpreted in accordance with the laws of Victoria, Australia without regard to any principles of conflicts of laws.

By agreeing to this Agreement, you consent to the jurisdiction of the courts of Victoria to resolve any disputes arising from this Agreement.

20. DISCLAIMERS 

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE WEBSITE AND RELATED SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TASKEASY AND ITS OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN ADDITION, YOUR USE OF THE WEBSITE IS ALSO SUBJECT TO THE ADDITIONAL DISCLAIMERS AND CAVEATS THAT MAY APPEAR THROUGHOUT THE WEBSITE.

TASKEASY AND ITS AGENTS ASSUME NO RESPONSIBILITY FOR ANY CONSEQUENCE RELATING DIRECTLY OR INDIRECTLY TO ANY ACTION OR INACTION YOU TAKE BASED ON THE INFORMATION, SERVICES, OR OTHER MATERIAL ON THE WEBSITE. WHILE COMPANY STRIVES TO KEEP THE INFORMATION ON THE WEBSITE ACCURATE, COMPLETE, AND UP-TO-DATE, TASKEASY CANNOT GUARANTEE, AND WILL NOT BE RESPONSIBLE FOR, ANY DAMAGE OR LOSS RELATED TO THE ACCURACY, COMPLETENESS, OR TIMELINESS OF THE INFORMATION ON THE WEBSITE.

21. LIMITATION OF LIABILITY 

EXCEPT WHERE PROHIBITED BY APPLICABLE LAW, IN NO EVENT WILL THE TASKEASY OR ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AGENTS, PARTNERS OR THIRD PARTY SERVICE PROVIDERS BE LIABLE FOR ANY DAMAGES (WHETHER DIRECT, INDIRECT, EXEMPLARY, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES (INCLUDING LOST PROFITS, LOSS OF DATA OR LOSS OF USE) ARISING OUT OF OR IN ANY WAY RELATED TO THESE TERMS OR YOUR USE OR INABILITY TO USE THE SITES, ANY WEBSITES LINKED TO IT, ANY CONTENT OR SERVICES MADE AVAILABLE ON THE SITES, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF THE TASKEASY OR ANY OF ITS AFFILIATE PARTNERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES (COLLECTIVELY, THE “EXCLUDED DAMAGES”).
